Please note that StreetText does not offer legal advice. We have done our best to interpret the FCC rules. For full clarity on the rules we recommend contacting a law firm that specializes in these rules.
DNC
StreetText will check the DNC list on your leads anytime a message is about to be sent. We will label the number with the appropriate status. If they lead is on the DNC then the automated messages will not be sent.

The phone number is on the DNC list. Automated messages cannot be sent unless they have given explicit written consent. You can manually message the lead if it is in regard to the inquiry.

SMS Opt-in/Opt-out
FCC rules requires that a lead opts into receive automated text and voice messages from you. There are 2 types of consent a lead can give you.
Implied Consent
Implied Consent is implied in the form submission and is related to the inquiry the lead has submitted their info on. So for example if a lead submits their info on a property listing automated messages can be sent to the lead regarding the property listing.
β
This is a soft opt-in as it does not require the lead to give any more consent other than just submitting their info. By default this is the consent your ads will have when you launch them.
This consent expires after 90 days. If the lead replies to you then the expiry resets.
If a lead is on the DNC list then with implied consent the lead cannot be sent automated messages.
Explicit Written Consent
Explicit Written Consent is given by an extra step on the form submission by having a lead check of a box giving you consent to contact them. Here is an example:
β
Explicit consent is the gold standard of opt-in and gives you the most compliancy with FCC rules and protecting you legally. However it may result in fewer leads you are able to contact via automated messaging.
β
When you launch an ad you can select the type of consent you would like the ad to have.
Explicit consent expires after 18 months unless the lead is on the DNC list then expires after 90 days. The expiry resets when the lead replies.
Opt-in Display Status
StreetText will display the Opt-in status of a lead beside the phone number.
Implied consent expires in 90 days.
Explicit Written consent expires in 18 months. If on the DNC then it expires in 90 days.
