This guide is to help you understand important updates to our terms and conditions concerning the use of your StreetText-provisioned phone number for texting leads that you source from outside the StreetText platform (we refer to these as "External Leads"). This most commonly applies to leads managed in third-party CRMs like Follow Up Boss, which you then message using your StreetText number.
These new terms are outlined in the "Addendum to StreetText Messaging Services Agreement: Use of StreetText-Provisioned Numbers for Texting External Leads via Third-Party CRMs" and are effective as of [Date of Implementation - same as in your T&Cs].
Why Are These New Terms Being Introduced?
Our goal is to ensure that all messaging conducted through the StreetText platform is compliant with current telecommunication laws (like the TCPA in the U.S. and CASL in Canada) and A2P 10DLC carrier requirements. This protects you (the agent), your leads, and StreetText, and helps maintain the high deliverability of our messaging service. These terms clarify your crucial role and responsibilities when interacting with External Leads using a StreetText-provisioned number.
What Are "External Leads"?
"External Leads" are any contacts or leads that:
Were not generated directly through StreetText's lead capture forms or tools.
You have imported or manage within a third-party CRM (e.g., Follow Up Boss, or any other system) and subsequently message using your StreetText-provisioned phone number.
Key Responsibilities for Texting External Leads (Summary):
The full details are in the Addendum, but here’s a summary of your key responsibilities when texting External Leads using your StreetText number:
Sole Responsibility for Consent:
You are solely responsible for obtaining and documenting valid, prior consent from every External Lead before you send them any text messages via your StreetText number.
For U.S. Leads: This generally means obtaining Prior Express Written Consent (PEWC) as defined by the TCPA. This consent must be clear, conspicuous, identify you (the sender), state that messages may be sent using an autodialer (if applicable), and confirm that consent is not a condition of purchase.
For Canadian Leads: This generally means obtaining Express Consent as defined by CASL. This requires identifying yourself, stating the purpose of the messages, providing your contact information, and informing them they can unsubscribe.
Compliance with All Applicable Laws: You must ensure your messaging practices fully comply with all relevant laws, including TCPA, CASL, National Do Not Call (DNC/DNCL) list rules, and any state/provincial regulations.
A2P 10DLC Campaign Integrity:
Your StreetText-provisioned number is linked to an A2P 10DLC campaign registered on your behalf or for which you are responsible.
All your messaging (to any lead) must align with the use case, sample messages, and opt-in processes described in your campaign registration. Deviating from this can jeopardize your campaign.
Accurate Record Keeping: You must maintain detailed records of how and when consent was obtained for each External Lead for at least five years. Be prepared to provide these records if requested.
Clear Identification & Honoring Opt-Outs: Your messages should clearly identify you. You must provide a clear way for recipients to opt-out (e.g., reply STOP) and honor all opt-out requests promptly (within 10 business days, or sooner if required by law).
Why Are These Responsibilities So Important?
Legal Penalties: Non-compliance with TCPA and CASL can lead to significant fines and legal action against you.
Carrier Enforcement: Mobile carriers actively monitor messaging traffic for spam and unconsented messages. Non-compliant messaging can lead to your A2P 10DLC campaign being suspended, your number being blocked, and even impact StreetText's ability to provide messaging services.
Protecting Your Reputation: Sending unwanted messages damages your professional reputation and your relationship with potential clients.
Action Required: Review and Accept the Terms
All StreetText users who wish to use their StreetText-provisioned numbers for texting External Leads (e.g., via Follow Up Boss) must review and formally accept the "Addendum to StreetText Messaging Services Agreement."
Deadline for Acceptance:
Please review and accept these terms by Wednesday, June 4, 2025.
What Happens If You Don't Accept the Terms?
If the new Addendum is not accepted by June 4, 2025, your ability to use your StreetText-provisioned number to send text messages to External Leads (such as those in Follow Up Boss or other third-party CRMs) will be suspended. This measure is essential to ensure all messaging conducted via our platform meets the required compliance standards.
Frequently Asked Questions (FAQs)
Q: What if I don't want to message external leads?
A: You can disable external leads by visiting the Integrations page for Follow up Boss and turning off "Scheduled Conversations"
Q: I only text leads that I generate directly through StreetText's tools. Does this Addendum apply to me?
A: This Addendum specifically addresses your responsibilities when texting "External Leads." If you only text leads generated through StreetText forms (where StreetText has helped establish the initial consent framework), these specific terms regarding External Leads won't directly govern those interactions. However, the principles of compliant messaging (like honoring opt-outs and clear identification) always apply.
Q: What specific type of consent do I need for my Follow Up Boss leads if I want to text them using my StreetText number?
A: As outlined above, for U.S. leads, you need Prior Express Written Consent (PEWC). For Canadian leads, you need Express Consent under CASL. The responsibility for having this before you message them lies with you. You cannot rely on any consent potentially obtained by StreetText for leads generated on our platform to cover these External Leads.
Q: How can I ensure I have the right consent for my External Leads?
A: You must have a clear record of how the lead provided consent specifically to receive marketing text messages from you. This might be through a form on your own website, a documented verbal agreement (though written is always safer for PEWC), or another compliant method where you clearly disclosed who would be texting and for what purpose. If you are unsure if you have the correct level of consent for an External Lead, you should not text them using automated means or for marketing purposes via your StreetText number.
